The owner of the online store at https://miumjau.ee/ (hereinafter referred to as the Online Store) is MiuMjau OÜ (registration number 14687325), located at Käbliku 5, Tallinn, 13426, Harju County.
Validity of the Sales Agreement, Product, and Price Information
These terms and conditions apply when purchasing goods from the Online Store.
Information about the products is provided directly at the respective product in the Online Store.
The prices of the products sold in the Online Store are indicated next to the products. In addition to the price, a fee for the delivery of the goods will apply.
The delivery fee depends on the buyer’s location and the delivery method. The delivery fee will be displayed to the buyer when placing the order.
Delivery Fees in Estonia:
- To Omniva parcel terminal, starting from – 3 €;
- Courier fixed fee for shipments up to 30kg – 8 €.
- Courier fixed fee for shipments 30kg and above – 15 €.
At the moment, we also offer courier service to Finland, Latvia and Lithuania. The price list is automatically displayed at the checkout according to the weight of the purchase.
Order Processing
To order the products, the desired items must be added to the shopping cart. To complete the order, the required fields must be filled, and a suitable method for product delivery must be selected. Subsequently, the screen will display the amount to be paid, which can be settled via bank transfer. An invoice will be automatically sent to the buyer’s email.
The agreement comes into effect upon the receipt of the payable amount in the Online Store’s bank account.
If the ordered goods cannot be delivered due to the depletion of stock or for other reasons, the buyer will be notified at the earliest opportunity, and the paid amount (including the delivery costs) will be refunded promptly but no later than within 14 days from the date of notification.
Delivery
Goods are shipped to the following countries: Member States of the European Union.
The shipping costs are paid by the buyer, and the relevant pricing information is displayed next to the shipping method.
For domestic shipments in Estonia, the goods usually reach the buyer’s designated destination within 1-3 working days after the payment has been received by the seller. Outside Estonia, the delivery will take place within 14 calendar days.
In exceptional cases, there is the right to deliver the goods within a period of up to 30 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
The right of withdrawal does not apply if the buyer is a legal person.
To exercise the 14-day right of return, the ordered product must not be used in any way other than what is necessary to ascertain the nature, characteristics, and functioning of the product, just as it would be allowed to test the product in a physical store.
If the product has been used for purposes other than necessary to ascertain its nature, characteristics, and functioning, or if it shows signs of use or wear and tear, the Online Store has the right to reduce the refundable amount based on the decrease in the value of the product. (In general, we request to send photos of the product to prove that it has not been used)
To return the product, a statement of withdrawal from the purchase must be submitted and sent to the email address miumjaupood@gmail.com no later than 14 days from the receipt of the product.
The cost of returning the product is paid by the buyer, unless the reason for the return is that the item to be returned does not correspond to what was ordered (e.g., wrong or defective item).
The buyer must return the product within 14 days following the submission of the withdrawal statement or provide evidence that they have handed over the product to the carrier within that period. The product must be returned in its original packaging, i.e., in the same packaging in which the buyer received the product. The product must be returned in the same condition as it was originally sent. If the packaging is damaged or discarded, the seller must be informed immediately, and the seller has the right to charge a fee of 20% of the product’s sales price for the decrease in the product’s value. If the product has been kept in an unclean environment or has absorbed cigarette odors, we consider the product used, as it has not been returned in the same condition as it was originally sent. The reason for this is that scratching posts contain a lot of textile that absorbs all the odors.
The online store will promptly, but no later than 14 days after receiving the returned product and the statement of withdrawal, reimburse the buyer for all payments received under the contract. If the order is returned partially, we will refund the postage paid proportionally to the number of returned products. We will inspect the product, and if everything meets the above conditions, we will refund the purchase amount immediately.
The online store may refrain from making refunds until the item that is the subject of the contract has been returned or until the buyer has provided evidence of having returned the item, whichever occurs first.
If the buyer has expressly chosen a different method of delivery than the cheapest standard delivery offered by the online store, the online store is not required to reimburse the consumer for the cost exceeding the standard delivery cost.
The online store has the right to withdraw from the sales transaction and demand the return of the product if the price of the product in the online store has been significantly misstated due to an error.
Right to Submit a Claim
The online store is responsible for non-compliance with the terms of the sales agreement or defects in the goods sold to the buyer, which already existed at the time of delivery and which become apparent within two years from the delivery of the goods to the buyer. During the first six months from the delivery of the goods to the buyer, it is presumed that the defect already existed at the time of delivery. It is the duty of the online store to rebut this presumption.
In the event of a defect occurring, the buyer has the right to contact the online store within two months at the latest by sending an email to miumjaupood@gmail.com or calling +372 5812 1217.
The online store is not responsible for defects that have occurred after the product has been handed over to the buyer.
If the product purchased from the online store has defects for which the online store is responsible, the online store will repair or replace the defective product. If the product cannot be repaired or replaced, the online store will reimburse the buyer for all fees associated with the sales agreement.
The online store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
Processing of Personal Data
The online store uses the personal data provided by the buyer (including name, phone number, address, email address, bank details) only for order processing and sending the goods to the buyer. The online store will transmit the personal data to the companies providing transportation services to deliver the goods.
Dispute Resolution
If the buyer has complaints about the online store, they must be sent to the email address miumjaupood@gmail.com or anettetuulik@gmail.com or call +372 5812 1217.
If the buyer and the Online Store cannot resolve the dispute by mutual agreement, the buyer has the option to turn to the Consumer Disputes Commission. The procedural terms can be reviewed, and a complaint can be submitted on the Consumer Disputes Commission’s website.
The Consumer Disputes Commission is competent to resolve disputes arising from the sales agreement between the buyer and the Online Store. The review of the buyer’s complaint in the commission is free of charge.
The buyer may also contact the European Union platform for resolving consumer disputes.
